Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Aaron, the individual developer of TripNoti ("TripNoti," "we," "us," or "our"), governing your access to and use of the TripNoti mobile application (the "App"), website at tripnoti.com, and all related services (collectively, the "Service").

By creating an account, downloading the App, or otherwise accessing the Service, you confirm that:

• You have read, understood, and agree to be bound by these Terms;
• You are at least 18 years of age;
• You have the legal capacity to enter into a binding agreement;
• Your use of the Service complies with all applicable laws and regulations in your jurisdiction.

These Terms should be read alongside our Privacy Policy, which is incorporated herein by reference.

2. Description of Service

TripNoti is a flight price intelligence and tracking application that provides the following features:

• Flight Price Tracking: Monitor the price of specific flight routes and receive notifications when prices change.
• AI Price Probability: Receive AI-generated predictions on whether a flight fare is likely to increase or decrease, to help you decide when to book.
• Live Flash Price Feed: Browse a curated feed of discounted flight deals updated regularly.
• Push Notifications: Receive real-time alerts when tracked flights hit your desired price point.
• Premium Subscription: Access to enhanced features including extended tracking, more alerts, and priority updates.

3. Eligibility

To use TripNoti, you must:

• Be at least 18 years of age. If you are under 18, you are not permitted to use this Service under any circumstances.
• Have the legal authority to enter into a binding contract under the laws of your country of residence.
• Not be located in a country subject to a Malaysian government or international embargo or trade sanction, or that has been designated as a "terrorist supporting" country.
• Not be listed on any government prohibited or restricted parties list.

By using TripNoti, you represent and warrant that you meet all of the above eligibility requirements. We reserve the right to request proof of age or identity at any time and to suspend or terminate your account if we have reason to believe that you do not meet these requirements.

4. User Accounts

4.1 Account Registration

You may register for a TripNoti account using your:

• Email address and password
• Google Account (via Google Sign-In)
• Apple ID (via Sign in with Apple)

By using a third-party sign-in method, you authorize TripNoti to access the basic profile information (name and email address) associated with that account, subject to the privacy settings of that third-party service.

4.2 Account Security

You are solely responsible for:

• Maintaining the confidentiality of your account credentials;
• All activities that occur under your account;
• Notifying us immediately at support@tripnoti.com if you suspect any unauthorized access to your account.

TripNoti will not be liable for any loss or damage arising from your failure to comply with these security obligations.

4.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to keep your account information updated. We reserve the right to suspend or terminate accounts that contain false, inaccurate, or misleading information.

4.4 One Account Per User

Each user may maintain only one active TripNoti account. Creating multiple accounts to circumvent bans, obtain additional free tier benefits, or for any other reason is strictly prohibited.

5. Subscriptions & Billing

5.1 Free Tier

TripNoti offers a free tier that allows users to access basic flight price tracking and live deal features with certain limitations on the number of tracked routes and notifications.

5.2 TripNoti Premium

TripNoti Premium is a paid subscription that unlocks enhanced features. Subscription options, pricing, and billing cycles are displayed clearly within the App at the time of purchase.

5.3 Billing & Payment

• All payments are processed through the Apple App Store or Google Play Store, managed by RevenueCat.
• Your subscription will be charged to your Apple ID or Google Play account upon purchase confirmation.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the agreed subscription price.
• You can manage and cancel your subscription at any time via your Apple App Store or Google Play account settings.

5.4 Refund Policy

All subscription purchases are subject to the refund policy of the respective platform through which you purchased:

• Apple App Store: Refund requests must be made to Apple directly. We cannot process refunds for App Store purchases.
• Google Play Store: You may be eligible for a refund within 48 hours of purchase. After this period, refund requests are at Google's discretion.

In exceptional circumstances, you may contact us at support@tripnoti.com and we will do our best to assist, though we cannot guarantee refunds for completed transactions.

5.5 Price Changes

We reserve the right to modify subscription pricing at any time. We will provide at least 30 days' notice of any price changes via email or in-app notification. Continued use of the Premium subscription after the effective date of the price change constitutes acceptance of the new price.

5.6 Free Trials

If a free trial is offered, it will be clearly described in the App. If you do not cancel before the end of the free trial period, you will automatically be charged the applicable subscription fee.

6. Acceptable Use Policy

You agree to use TripNoti only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

• Use the Service for any unlawful, fraudulent, or malicious purpose;
• Attempt to gain unauthorized access to any part of the Service, its servers, or databases;
• Scrape, crawl, or systematically extract any data from the App or website using automated tools;
• Reverse-engineer, decompile, or disassemble any part of the App;
• Transmit any viruses, malware, or other harmful code through the Service;
• Interfere with or disrupt the integrity or performance of the Service;
• Create or use multiple accounts to abuse the free tier, circumvent limitations, or game the Service;
• Use the Service to mislead or deceive other users;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity;
• Use the Service in any manner that could damage, disable, overburden, or impair our infrastructure.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account, without notice and without refund.

7. Intellectual Property

7.1 TripNoti's Intellectual Property

All content within the TripNoti application and website — including but not limited to the app name, logo, design, text, graphics, user interface, software, algorithms, and features — is the exclusive intellectual property of TripNoti and is protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial purposes, subject to these Terms.

7.2 Restrictions

You may not, without our prior written permission:

• Copy, modify, distribute, sell, or lease any part of the Service;
• Use the TripNoti name, logo, or brand in any way that implies endorsement;
• Create derivative works based on any portion of the Service.

7.3 Your Content

You retain ownership of any content you submit to TripNoti (e.g., support emails, feedback). By submitting feedback or suggestions, you grant us a perpetual, royalty-free license to use such feedback to improve our Service without any obligation to compensate you.

7.4 Third-Party Flight Data

Flight prices and availability data displayed in the App are sourced from third-party providers (including TravelPayouts API and airline partners). This data is the property of the respective providers and is subject to their terms. TripNoti does not claim ownership of this data.

8. Disclaimers & Limitations of Liability

8.1 No Financial or Travel Advice

The flight prices, AI predictions, and deal recommendations provided by TripNoti are for informational purposes only and do not constitute financial, travel, or professional advice. You should conduct your own research and make booking decisions independently.

8.2 Price Accuracy

While we strive to provide the most accurate and up-to-date flight price information, we cannot guarantee the accuracy, completeness, or timeliness of any pricing data. Flight prices are highly dynamic and can change within seconds. TripNoti is not responsible for discrepancies between displayed prices and actual booking prices at the time of purchase.

8.3 Service Availability

We provide the Service on an "as is" and "as available" basis. We make no warranty that:

• The Service will be uninterrupted, timely, secure, or error-free;
• Notifications will be delivered within a specific timeframe;
• The AI price predictions will be accurate or reliable in all cases;
• Any defects in the Service will be corrected.

8.4 Limitation of Liability

To the maximum extent permitted by applicable law, TripNoti and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or savings resulting from reliance on price data or predictions;
• Flights missed or booked at a higher price due to delayed or missed notifications;
• Loss of data resulting from technical failures;
• Unauthorized access to your account by a third party.

In no event shall TripNoti's total cumulative liability to you exceed the greater of: (a) the amount you paid for the Service in the 12 months prior to the claim, or (b) RM 100 (Malaysian Ringgit).

8.5 Indemnification

You agree to indemnify, defend, and hold harmless TripNoti and its developer from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your infringement of any third-party rights.

9. Third-Party Links & Services

The TripNoti App and website may contain links to third-party websites, applications, or services, including airline booking pages and travel platforms. These links are provided for your convenience only.

TripNoti has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party services. We strongly recommend that you review the terms and privacy policies of any third-party services you access through TripNoti.

The following third-party services are integrated into TripNoti. Your use of the Service constitutes acknowledgment of their respective terms:

• Google Firebase — Terms of Service

• RevenueCat — Terms of Service
• TravelPayouts — Privacy Policy
• Apple App Store — Terms of Service
• Google Play Store — Terms of Service

10. Termination

10.1 Termination by You

You may terminate your account at any time by deleting the App and contacting us at support@tripnoti.com to request deletion of your account and associated data. Please note that terminating your account does not automatically cancel any active subscriptions — you must cancel those separately through the Apple App Store or Google Play Store.

10.2 Termination by TripNoti

We reserve the right to suspend or permanently terminate your access to the Service, with or without notice, if:

• You breach any provision of these Terms;
• Your use of the Service is determined to be fraudulent, abusive, or harmful to other users or the integrity of the platform;
• We are required to do so by law or court order;
• We determine, at our sole discretion, that your actions are detrimental to TripNoti.

10.3 Effect of Termination

Upon termination, your right to access and use the Service ceases immediately. Any data associated with your account will be handled in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination will remain in effect, including Sections 7 (Intellectual Property), 8 (Disclaimers), and 11 (Governing Law).

11. Governing Law & Disputes

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. The Malaysian Consumer Protection Act 1999, Personal Data Protection Act 2010 (PDPA), and Communications and Multimedia Act 1998 may also be applicable to your use of the Service.

11.2 Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service, we encourage you to first contact us at support@tripnoti.com to seek an informal resolution. We will make every reasonable effort to resolve your concern within 30 days.

If an informal resolution cannot be reached, you agree that any legal action shall be brought exclusively in the courts of competent jurisdiction located in Malaysia, and you hereby consent to the personal jurisdiction of such courts.

11.3 Class Action Waiver

To the extent permitted by applicable law, you agree to resolve disputes with TripNoti on an individual basis only, and not as part of any purported class, collective, or representative proceeding.

12. Changes to These Terms

We reserve the right to modify these Terms at any time at our sole discretion. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page;
• Notify registered users via email and/or in-app notification at least 14 days before the changes take effect (for material changes);
• Require you to re-accept the updated Terms before continuing to use the Service, where required by law.

Your continued use of TripNoti after the effective date of any updated Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

For minor changes (such as typographical corrections or clarifications that do not materially affect your rights), we may update the Terms without specific notice beyond updating the "Last Updated" date.

Miscellaneous

Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by TripNoti, constitute the entire agreement between you and TripNoti concerning the Service and supersede all prior agreements.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be modified only to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of TripNoti.

Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. TripNoti may assign its rights and obligations under these Terms without restriction or prior notice.

Force Majeure

TripNoti shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, pandemic, natural disasters, government actions, or internet or infrastructure failures.
